These terms govern the deployment of infrastructure. Read them like an operator. Not like a user. NorixPlatform is not a consumer application. These terms are written to be read, understood, and confirmed by the person in the operator organization who has authority to make a deployment decision.
Access to NorixPlatform begins with the operator's submission of an Activation Request and BlueWave Technology's written confirmation of fit and deployment readiness. Activation is not automatic. BlueWave Technology reserves the right to decline any Activation Request at its sole discretion.
Every authorized user must complete the System Scope Acknowledgement before accessing the platform. The SSA is a scroll-to-end gate. It is not a checkbox. Completion is time-stamped and user-identified and recorded in the operator's account.
The operator is responsible for managing authorized user access. This includes provisioning access to staff and contracted guards, revoking access when employment or contract status changes, and ensuring that access levels are appropriate to each user's role.
When the operator authorizes contracted security personnel to use the platform, the operator assumes full responsibility for those users' compliance with these terms. BlueWave Technology is not a party to the operator's agreement with any contracted security firm.
There is no trial tier and no free tier. Activation constitutes a deployment decision. Billing begins on the activation date as specified in the operator's service agreement.
The operator may use NorixPlatform to log documented notices of conditions observed on private property, document operational response actions, maintain a portfolio-level record of conditions and responses, and create and disclose Encrypted Evidence Bundles through the controlled disclosure protocol.
The operator may not use NorixPlatform to document individuals by name, identity, or biometric characteristic in the operational layer. The operator may not use the platform to conduct surveillance of residents, visitors, or guests for purposes unrelated to documented notice. The operator may not use the platform to make determinations about any individual's conduct, character, or status. The operator may not use the platform in any manner that violates applicable federal, state, or local law including but not limited to the Fair Housing Act, the Americans with Disabilities Act, or applicable state biometric privacy laws.
Every Documented Notice must include a location designation before submission. Location designations are configured at the property level during onboarding. Documentation logged without a valid location designation will not be accepted by the system.
The platform's Live Language Advisory is advisory only. It flags documentation language that may create Fair Housing or other legal exposure and presents alternative phrasing. The advisory never blocks a submission. The operator assumes full responsibility for the language of all documentation submitted through the platform.
The operator is the operator of record for all properties enrolled in NorixPlatform. NorixPlatform provides infrastructure. The operator retains full legal responsibility for the duty obligations that infrastructure supports.
NorixPlatform surfaces information. It makes no determinations. It does not tell the operator what to do, when to act, or how to respond to any condition documented on the property. All operational decisions, escalation decisions, and disclosure decisions remain exclusively with the operator.
The operator is solely responsible for Fair Housing compliance across their portfolio and their use of the platform. The platform's architectural separation between condition documentation and individual documentation is designed to support Fair Housing compliance. It does not guarantee it.
The operator is responsible for training all authorized users on the proper use of the platform, the meaning and requirements of the System Scope Acknowledgement, and the operator's internal documentation policies and protocols.
The operator is responsible for retaining legal counsel appropriate to its duty obligations. BlueWave Technology is not a law firm. Nothing in these terms or in the platform's design constitutes legal advice.
An Encrypted Evidence Bundle is created only by the deliberate decision of the operator and retained legal counsel. It is never generated automatically. It is never generated in response to a platform trigger or notification.
An EEB may be disclosed only to law enforcement agencies with jurisdiction over the matter, licensed insurance carriers with a documented interest in the matter, and retained legal counsel representing the operator in connection with the matter.
Before an EEB is disclosed to any authorized recipient, the receiving party must acknowledge in writing that correlation is not attribution, the system provides no determinations, and the receiving party retains full investigative and legal discretion.
Every EEB creation and disclosure event is recorded in the operator's account. This record is permanent. It cannot be deleted or modified by the operator.
BlueWave Technology will not disclose any operator data in response to law enforcement requests, subpoenas, or court orders that do not comply with the controlled disclosure protocol and applicable law. BlueWave Technology will notify the operator of any such request promptly and to the extent permitted by law.
NorixPlatform operates on issued U.S. Patent No. 11,830,346 B2 with additional patents pending. The operator's activation of NorixPlatform constitutes a limited, non-exclusive, non-transferable license to use the platform's patented infrastructure for the purposes described in these terms.
Nothing in these terms transfers ownership of any intellectual property to the operator. The operator receives a deployment license. That license does not include the right to replicate, reverse engineer, sublicense, or otherwise exploit the platform's architecture outside the scope of these terms.
The operator retains ownership of the Documented Notice records, response action records, and disclosure records generated through the operator's use of the platform. BlueWave Technology holds a limited license to use this data for platform operation, security monitoring, and the aggregate research functions described in the Privacy page.
BlueWave Technology may contribute de-identified, aggregated pattern data derived from platform usage to institutional research conducted through Meridian Risk Studies. This data does not include property-level records, operator identification, or any data traceable to a specific property, staff member, or location.
Operators who wish to exclude their de-identified data from aggregate research may request exclusion through their service agreement.
NorixPlatform is priced by property size on a room-tier basis. Portfolio discounts apply when three or more properties are active under the same account. Payment is due on the schedule specified in the operator's service agreement. BlueWave Technology does not accept credit card payment for NorixPlatform deployments.
These terms are effective from the date of activation and continue for the term specified in the operator's service agreement. Upon termination, BlueWave Technology will provide the operator with an export of their Operational Notice Records in a standard format within thirty days. Data is retained in accordance with the retention schedules described in the Privacy page.
NorixPlatform provides infrastructure. It does not provide legal advice, compliance guidance, security services, or any guarantee of outcome in litigation, regulatory proceedings, or insurance claims. The platform supports the operator's documentation practices. It does not guarantee their adequacy.
NorixPlatform is provided as-is. BlueWave Technology makes no warranty, express or implied, regarding the platform's fitness for any particular purpose, uninterrupted availability, or freedom from error.
To the maximum extent permitted by applicable law, BlueWave Technology's total liability to the operator for any claim arising out of or related to these terms or the operator's use of the platform shall not exceed the total fees paid by the operator to BlueWave Technology in the twelve months preceding the claim. BlueWave Technology is not liable for indirect, incidental, consequential, or punitive damages of any kind.
The operator agrees to indemnify and hold harmless BlueWave Technology and its officers, directors, employees, and operating entities from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of the operator's use of the platform, the operator's breach of these terms, or the operator's violation of applicable law.
These terms are governed by the laws of the State of Oklahoma without regard to conflict of law principles. The parties agree to attempt good-faith resolution of any dispute before initiating formal proceedings. Any legal proceedings shall be brought in the state or federal courts located in Tulsa County, Oklahoma.
These terms, together with the operator's service agreement and the Privacy page, constitute the entire agreement between the operator and BlueWave Technology with respect to NorixPlatform.
BlueWave Technology may update these terms from time to time. Material changes will be communicated to the operator through the platform and via the contact information on file.
